The Situation to the Police Immediately Upon Arrival at the Station.

If you are able without putting yourself or others at risk, get the driver’s information, especially the license plate. In this way, if the other driver leaves prior to the arrival of the police, you have identifying information to give the police.  Again, if you are physically able and feel safe to do so, take pictures with your cell phone.

No matter what the specific circumstances, take care of your passenger(s) and your physical needs. Go in an ambulance from the scene, if you are injured.

As soon as you are able, yes, you should contact a lawyer. He or she will be able to get the police report. Find out if alcohol is involved in the accident, as well as other important facts. If the driver was drinking prior to the accident, the lawyer can see if there is also a cause of action against the restaurant or bar that serve the drive the alcohol–a dram shop action.   The lawyer can also advise you to any Underinsured or Uninsured cause of action if the driver did not have any or enough insurance.
